Welcome to The Backyard Golf Club, operated by BTM Technologies LLC (“Company,” “we,” “our,” or “us”). By creating an account or using our services, you agree to these Terms of Service.

1. Eligibility

Our services are intended for users who are at least 18 years old. Users 13 to 17 may participate only with parental or guardian consent. The service is intended for U.S. residents only.

2. Accounts

You must provide accurate information when creating your account, including your name, email, username, and date of birth. You are responsible for maintaining the security of your account and for all activities under it.

3. User Content

You retain ownership of any content you submit, including swing videos, photos, and golf statistics. By uploading content, you grant us a broad, worldwide, royalty-free license to use, reproduce, modify, and analyze your content as necessary to provide and improve our services, including AI/ML training, research, and product development. We may also use aggregated or anonymized data for marketing purposes and partnerships.

4. Acceptable Use

You agree not to misuse the service, including engaging in illegal activities, harassing others, interfering with the platform, or attempting to reverse-engineer our software.

5. Payments

Some services require a paid subscription, processed via Stripe. All fees are non-refundable except as required by law. We may change pricing with prior notice.

6. Intellectual Property

All software, trademarks, and content provided by us are our property or licensed to us. You receive a limited, non-exclusive, revocable license to use the service for personal, non-commercial purposes.

7. Termination

We may suspend or terminate your account if you violate these Terms. You may also delete your account at any time.

8. Disclaimers

The service is provided “as is” without warranties of any kind. We do not guarantee uninterrupted access or that results will meet your expectations.

9. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the amount you paid us in the 12 months prior to the claim. We are not responsible for indirect, incidental, or consequential damages.

10. Dispute Resolution

Any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, rather than in court. You waive any right to a jury trial or class action. Governing law is the laws of the State of Ohio.

11. Changes to Terms

We may update these Terms from time to time. If material changes are made, we will notify you via email. Continued use of the service constitutes acceptance of updated Terms.
